watermark - all photos for download have a watermark, which is part of the photo. If you would like photos without a watermark, please contact us before placing the order to agree on changes. Any additional changes to the photos according to the customer's wishes are charged.
selection of printed photos (the company reserves the right to select photos based on current photographic creativity and artistic inspiration),
custom-made products (after a prior preview) - canvases, photo books, ...
price - even if the customer finds a cheaper provider after the photo shoot and wants to get the service already provided at the same (lower) price,
online purchases - once purchased online, downloaded photos are not eligible for complaints or refund claims
if the customer did not point out any disturbing elements during the preview phase.
After the preview phase and the customer's observations have been resolved, replacement or modification is no longer possible, as photographs taken in our studio or in nature are considered unique products made to order. The same applies to custom-made products.
The customer may only complain about photographs or products if they are not in accordance with the previous agreement (i.e. if the corrections that the customer pointed out in the preview phase have not been resolved) or if the products are damaged, and this must be done no later than 48 hours after receipt. Later complaints in the case of an obvious defect are not taken into account.
Material defects must be reported immediately after discovery, or at the latest within the legally prescribed period of six months.
In the event of a justified complaint, the company first has the right to a replacement delivery. If the replacement delivery deviates from the customer's requirements, only the customer has the right to request cancellation of the contract or a price reduction. In the event of cancellation of the contract, the customer is obliged to return all goods, covering the shipping costs themselves.
DISCLAIMER
The company makes every effort to ensure that the information published on the website is up-to-date and correct. However, product features, availability and prices may change so quickly that the provider is unable to correct the information in a timely manner. In such a case, the provider will notify the buyer of the changes and allow him to cancel the order or replace the ordered product.
RIGHT TO WITHDRAWAL FROM THE PURCHASE, RETURN OF GOODS/REFUND OF PURCHASE
You can select and order photos that are available to you in the online gallery. All products listed on these pages are available until stocks run out - for the duration of the gallery's availability (6 months). The delivery time for ordered goods is up to 7 working days (usually delivered within 3 days), if the goods are currently out of stock, we will inform you of the expected delivery date as soon as possible. In the event of possible unavailability of the ordered items, we will inform you of the changes and allow you to cancel the order, replace the ordered item or some other agreed option. The company must deliver the goods within the promised time, but we reserve the right to extend the delivery period due to delays with the manufacturer or supplier.
In accordance with the provisions of Article 43. č of the Consumer Protection Act (ZvPot), the consumer will be refunded the money immediately or no later than 14 days after receiving the notification of withdrawal from the contract. The consumer must return the goods unused, undamaged in the original packaging immediately or no later than 14 days after receiving the notification of withdrawal from the contract. The provider is not obliged to accept shipments with a ransom or shipments that do not comply with the provider's general terms and conditions.
The consumer can send the withdrawal from the order to the contact email address info@foto-niko.si without having to state the reason for his decision. The message is considered to be timely if it is sent within 8 days of receiving the pro forma invoice.
The buyer does not have the right to return the goods in cases where the goods were manufactured according to the client's precise instructions - unique products. The costs of re-sending the goods are covered by the provider.
COMPLAINTS
The buyer may make a complaint about the goods if the goods do not have the properties promised by the company, if the wrong products were delivered, in the wrong quantity, color, size or otherwise deviate from the order. The buyer may make a complaint about the goods within 8 days of purchase and request an immediate replacement or refund of the purchase price.
The complaint must be submitted in writing with an explanation. The buyer may return the goods subject to the complaint by bringing them personally after prior agreement with the company or by returning them by mail at the seller's expense and after prior agreement with the company. We do not accept shipments with a ransom without agreement. Upon return, the buyer requests a refund of the purchase price, which the seller will return to his transaction account (TRR) no later than 15 days from the receipt of the returned goods.
The complaint does not apply to goods with a print, if the print was not ordered from the seller. In the event that the stock of the item runs out, the seller does not guarantee the re-delivery of the item.

PRODUCT DELIVERY
Delivery of ordered goods is carried out by prior agreement between the customer and the company. Ordered photographs, photo books and photographs printed on canvas are sent via Pošta Slovenije. The delivery cost is paid by the buyer when ordering.
All products are packed and protected in cardboard packaging. We do not charge for packaging and wrapping. All products will be sent as soon as possible. In the event that an ordered item is currently out of stock, we will notify you by email or phone
